Jack FRS sells with the latest version (now 3.0), and had actually included the ability to upgrade from v2.4.9 to v3.0 for radios they sold in last few months of 2018.

Given the "point" releases are downloadable (like 3.0.19 to anything higher short of a presently hypothetical 4.0.x) by a radio licensed for v3.x kind of expect to do some updates if you want the latest features & fixes.

BTW a radio licensed to a certain major upgrade level (like the current 3.0.x) can in theory "downgrade" to lower levels.  I've done a few 3.0.x to v2.4.9 as part of the testing processes, though I have to admit I've never reverted back to any v1.x versions since v2.x came out.

Hope I've answered your question and some of the usual follow on questions.
